This privacy policy describes the processing of your personal data by the ABERTIS PRIVATE FOUNDATION (hereinafter, "Abertis Foundation"), in the context of the "Zero Accidents AI Challenge" promoted by the Abertis Foundation (hereinafter, the "Challenge")

What personal data do we process?

In general, the personal data that you provide to us (through the registration form) are: name and surname, address, postal code, e- mail address, contact phone number, contact list, fax number, nationality, and employment details. In very specific cases and depending on the purpose and intended use of your personal data, academic and professional data, employment details, commercial information, social, economic and insurance circumstances, transfer of goods and services may be collected.

We need the above personal data to fulfill your requests and successfully register your application and run the Challenge. Refusal to provide the data may make it impossible for you to register for the Challenge or to complete the process successfully.

If you provide third-party data, you are responsible for collecting the subject’s consent and for informing them of the contents of this privacy policy. You agree that Abertis Foundation shall not be responsible or liable, directly, or indirectly, for the use of any third-party data that you provide. In any case, Abertis Foundation may verify that you comply with your obligations from time to time and will apply the relevant due diligence measures in accordance with the applicable regulations.


For what purposes?

The Abertis Foundation will process your personal data for the following purposes:

  1. If you are interested in the Challenge, in order to correctly manage your application and contact in relation to the Challenge; 

  2. To manage your participation, once you have completed your registration form for the Challenge using the link available at http://www.f6s.com/zero-accidents-ai-challenge. The registration will entail an international personal data transfer to United Kingdom to “F6S Network Limited”;

  3. If necessary, to share your personal data with other companies in the Abertis Group for internal group administration purposes; 

  4. In order to comply with internal administrative purposes derived from the organization of the Challenge, excluding commercial purposes; 

  5. Where applicable, obtain your images during the course of the Event for later use, in accordance with the information provided to you in this policy; 

  6. Where applicable, inform to Abertis Infraestructuras, S.A. of your image or voice rights relating to the pictures or videos taken of you in the framework of the Challenge to allow Abertis Infraestructuras, S.A. to publish news about the Challenge in online and offline external media and communication campaigns, relating to the posting on their respective web pages. 

  7. To manage team formation, including selection, role assignment, definition of responsibilities, and assessment of the competencies required to achieve objectives, without involving profile creation.

  8. To manage the delivery of an incentive (award) if chosen as the winner.

Legitimation

The legal basis for processing your personal data based on the purposes described above is as follows: 

  1. In the case of your interest in the Challenge, the adoption of pre-contractual measures.

  2. If you complete your registration form for the Challenge using the link available at http://www.f6s.com/zero-accidents-ai-challenge, the execution of the contractual relationship with you; 

  3. Where appropriate, we will rely on our legitimate interest in disclosing your data to other companies within the Abertis Group, excluding commercial purposes; 

  4. Where appropriate, consent to use image according to this document; 

  5. Where appropriate, consent to communicate to Abertis Infraestructuras, S.A. the image or voice rights relating to the images taken of you in the framework of the Challenge according to this document.

  6. If applicable, we will rely on the execution of the contractual relationship established with you.
  7. If applicable, we will rely on the execution of the contractual relationship established with you for the delivery of the financial incentive upon project completion and after verifying that the results have been achieved.

With whom do we share your personal data?

Generally, Abertis Foundation will not disclose your personal data, except in the following cases:

  1. to competent authorities and bodies, courts, tribunals or any other third parties authorized in accordance with the applicable regulations; 

  2. to “F6S Network Limited”, as data controller, for the correct management of the Challenge registration process using the link available at http://www.f6s.com/zero-accidents-ai-challenge.This data communication takes place when you complete the registration process and involves an international transfer of personal data to the United Kingdom, which will be covered by an adequacy decision in accordance with Article 45 of the General Data Protection Regulation (GDPR) dated June 28, 2021;

  3. to “Innovation House, S.L.”, as data processor to provide consulting services to support the development and implementation of the Challenge; 

  4. to other companies within the Abertis Group, for internal administrative purposes, including the processing of personal data, excluding commercial purposes; 

  5. if applicable, to “Abertis Infraestructuras, S.A.” the image or voice rights relating to the images taken of you in the framework of the Challenge to allow Abertis Infraestructuras, S.A. to publicize the Challenge in online and offline external communication media and campaigns, through its web pages. 

However, Abertis Foundation has outsourced the provision of certain services (e.g., virtual infrastructure services, cloud computing, etc.) to suppliers who may have access to and/or process personal data in their capacity as processors. Such suppliers may process and store personal data on servers located outside your country of residence.

Therefore, depending on the location of the participant, data may be transferred to other countries. In this case, your personal data may be transferred internationally to third parties located outside the European Economic Area ("EEA"), provided that Abertis Foundation is authorized to do so and subject to compliance with the appropriate safeguards set out in Articles 44 to 50 of the GDPR. Such third parties will only access the data to carry out their services on behalf of and for the account of Abertis Foundation, under an obligation of confidentiality and always following its instructions and will not at any time use such data for their own purposes and/or unauthorized purposes. 

In any case, adequate safeguards include, but are not limited to:

  • Adequacy Decision: a declaration by the European Commission that a non-EU country provides an adequate level of data protection equivalent to that required by European data protection law, so that an international transfer of data to a third party established in that country outside the EU is possible; 

  • Binding Corporate Rules: these apply to groups of companies or associations of companies engaged in a common economic activity that allow the flow of personal data on the basis of self-regulation accepted and adopted by each of the signatories; 

  • Standard Corporate Rules: this is a mechanism signed between the exporter of personal data from one of the EEA countries and a third country. It is a contractual agreement, the model of which has been approved and published by the European Commission and is in line with the provisions of the GDPR; 

  • Code of Conduct or a certification mechanism, together with binding and enforceable commitments by the recipient to implement adequate safeguards for the protection of the transferred data. 

  • In the absence of the above, your personal data may exceptionally be transferred to a third country or international organization, in accordance with the mechanisms that may be recognized in this respect by data protection legislation. 



Abertis Foundation will conduct international transfers of personal data, in order of preference, under the following safeguards:

Standard Contractual Clauses 

As a secondary safeguard, we will subscribe and/or request a copy, as appropriate, from the importer of the personal data of the executed version of the Standard Contractual Clauses based on the models of the European Commission, available here: https://eur-lex.europa.eu/legal-content/ES/ALL/?uri=CELEX%3A32021D0914   

How long do we keep your personal data?

Abertis Foundation will keep your personal data for the purpose of participating and/or carrying out the Challenge (unless you ask us to erase them or object to them via the channels indicated in the "YOUR RIGHTS" section) and for the time necessary to fulfil any future obligations. Your personal data will be deleted at the end of the statutory periods. 

However, for each processing activity, we will inform you of the applicable data retention period for each processing activity in the information that we provide to you when your personal data is collected. We also inform you that we will take all reasonable steps to ensure that your data is rectified or deleted when it is inaccurate.

Data security

Abertis Foundation adopts appropriate security measures to prevent unauthorized access, disclosure, alteration or destruction of your personal data. 

Data will be processed using computers and/or IT tools, in accordance with procedures and organizational methods strictly related to the stated purposes. 

In cases where we transfer your information to suppliers by e-mail, our accounts are covered by additional security measures. All information stored on third party back-up systems requires an encrypted login. 

Your rigths

You are entitled to exercise your rights to access, rectify, erase, object to or restrict the processing of your personal data at any time, as well as your right to data portability. You must do so by sending an e-mail to the following address: lopd@abertis.com or a letter to the address of Abertis Foundation, located at Avenida Pedralbes, 17, 08034 Barcelona. These rights are inherent to each data subject and therefore cannot be waived and are as follows: 

  • Right of access: the right to access the personal data that are processed by Abertis Foundation in accordance with Article 15 GDPR; 
  • Right of rectification: the right to request that Abertis Foundation rectify certain personal data of the data subject in accordance with Article 16 GDPR; 
  • Right to object: the right to object to those processing operations that are based on consent or on the existence of a legitimate interest (including, but not limited to, the sending of commercial communications) in accordance with Article 21 GDPR. In cases where the processing is based on the existence of a legitimate interest, the data subject shall have the right to request the balancing test carried out by Abertis Foundation. In addition, in cases where the purpose of the processing is to send marketing communications from Abertis Foundation or third parties, the data subject may choose, free of charge and on a voluntary basis, to opt-out (more information can be found here https://www.listarobinson.es/). 
  • Right to erasure: the right to request Abertis Foundation to erase all or part of the data subject's personal data in accordance with Article 17 GDPR. Please note that while the commercial and/or contractual relationship that we have with you is still in force, there is a set of personal data that we need to process in order to fulfill the contract, so while it remains in force we cannot delete, block or cancel it, because otherwise it would prevent us from fulfilling the contract; 
  • Right to restrict processing: the right to obtain from Abertis Foundation the restriction of the processing of your personal data if some of the conditions set out in Article 18 GDPR are met; 
  • Right to portability of personal data: the right to receive your data in a structured, commonly used and machine-readable format and, where technically feasible, to have it transmitted without hindrance to another controller, in accordance with Article 20 GDPR; 
  • Right to withdraw consent: given for the performance of the processing identified in the "Processing" section based on the data subject's consent, without such withdrawal having retroactive effect, in accordance with Article 7.3 of the GDPR; 
  • The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or significantly affects him or her. Abertis
  • Foundation informs the data subject that, although it carries out processing decisions based on automated systems, these decisions (i) either do not produce legal effects or significantly affect the data subject; (ii) or are not adopted solely by automated means. 

Please note that, due to different local regulations, there may be some of the rights described above that are not recognized by the local regulations of the country and therefore may not apply to you. This is the case, for example, with the most recent additions to the GDPR, such as portability or the right not to be subject to a decision based solely on automated processing.  

We will comply with your request as soon as possible and, in any event, within the statutory time limit. If we fail to comply with our data protection obligations or if you are not satisfied with how we have handled the exercise of your rights, you may contact us at the following e-mail address: lopd@abertis.com. You may also lodge a complaint at any time with the Supervisory authority (in the case of Spain, the Spanish Data Protection Agency).  

You are responsible for all the data you provide to us, for the truthfulness, accuracy, validity, updating, and authenticity of said data, as well as for the consent that you give us so that your data may be used/processed. You are also responsible for the data of third parties that you provide to us and for which you undertake to obtain their consent and to make available the information that we usually provide to our users for any data processing as well as our policy.  

Update

We may modify this policy at any time, but we will always notify you of any material changes by sending you a notice. If we make minor changes to our policy, we will update it with a new effective date that will be included in the document. The changes are not retroactive and will be effective from the date of publication. We encourage you to regularly review the policy, which can be found on our website.

1. General framework

The Abertis Private Foundation (hereinafter referred to as the "Abertis Foundation") is organizing the "Zero Accidents AI Challenge" to be held from November 5, 2024, to May 16, 2025 (the "Challenge Period") (for further information on Abertis Foundation, please refer to its website).

The purpose of this challenge focuses on innovation as a catalyst to transform traffic management and road safety. Its objective is to foster collaboration between the international startup ecosystem and the Abertis Group, in order to address the main business challenge at a global level.

2. Approach

The initiative arises from the desire to embark on open innovation projects. Abertis Infraestructuras, S.A. ("Abertis"), through its foundation, stands as a strong advocate of innovation and its main mission is to actively participate in the ecosystem to find possible solutions that can address the business challenges faced by the Abertis Group.

It is important to note that, although the Abertis Foundation initiates the "Zero Accidents AI Challenge", the management of this initiative will be carried out in close collaboration with the Abertis innovation department. This collaboration aims to stimulate the generation of creative and disruptive solutions with the valuable contributions of external entities.

2.1 The Challenge

The challenge proposed in this call is formulated in the following terms:

"How could we use AI with satellite and vehicle data to predict, prevent and manage traffic accidents, thus getting closer to the Zero Accidents vision?"

2.2. Context & Objectives

Abertis, as a global leader in infrastructure management, seeks to integrate differential technologies to move towards a Zero Accidents vision.

The "Zero Accidents AI Challenge" has three objectives:

  • Improve infrastructure monitoring: Being able to make a leap in our ability to obtain and manage data in the operation of infrastructures.
  • Identify hazardous situations and anticipate them: Through data analysis, establish risk prediction and accident prevention models.
  • Improved accident management: Manage accidents more effectively when they occur and mitigate their effects with a data-driven response.

Current Situation: 

Abertis is an international leader in highway management, managing approximately 7,700 kilometers of high-capacity, high-quality roads in 15 countries across Europe, America, and Asia, of which about 7,600 kilometers are managed directly. Its commitment to innovation and road safety is reflected in the use of advanced technologies to address the mobility challenges of the future, with a special focus on the "zero accidents" vision.

Abertis already uses innovative solutions in its traffic management centers, where technology plays a fundamental role. These centers integrate advanced systems, such as artificial vision processing and CCTV cameras, to optimize traffic flow, anticipate potential accidents, and respond efficiently in case of emergencies. This process is crucial to ensuring the highest level of service and safety on the highways managed by the company.

When an incident occurs, Abertis' control centers receive information from various sources: signals from systems and equipment installed on the highway (CCTV, weather stations), communications from internal or external teams, emergency services, highway users, or mobility applications like Waze or Google Maps. The initial information collected includes key details such as the type of accident, location, possible impact on the roadway, the state of the involved vehicle, and infrastructure conditions.

With this data, the control center follows a previously established manual of procedures, activating the appropriate resources, whether it be the intervention of emergency teams, signaling, or ITS technology. Additionally, the entire process is meticulously documented to ensure traceability, subsequent analysis, generation of statistical reports and KPIs, which help continuously optimize management and improve road safety.

This commitment to innovation and safety has already demonstrated Abertis' commitment to integrating technology and knowledge in building a safer future in global mobility infrastructure.

Desired Situation: 

From its current technological leadership in infrastructure management, Abertis seeks excellence in road safety through the implementation of advanced technologies that allow it to go a step further in the Zero Accidents vision. The desired situation involves the effective adoption of technological solutions that further and differentially optimize both the prevention and management of accidents, thus ensuring that the company continues to stand out in the management of high-capacity roads globally.

To this end, Abertis aims to implement innovative solutions that integrate the use of Data and Artificial Intelligence, with the goal of achieving the following results:

  • Predict the possible risk of accidents on high-capacity roads. This will involve improving predictive models that can anticipate potential problems and execute proactive interventions, resulting in a lower incidence of critical events.

  • Optimize the management of accidents that occur on our roads, improving the coordination and response times of emergency and signaling teams. The use of AI and data will allow a quicker and more effective response, minimizing the risks and consequences of accidents.

  • Incorporate new technologies in infrastructure management to adapt and enhance existing capabilities, adding new differential solutions that substantially improve the current operation of high-capacity roads, which are already distinguished by their safety and efficiency.

  • Continue evolving towards a more proactive model, where we increasingly identify and address issues before they escalate into complex interventions or severe accidents.

By effectively implementing these Data and AI-based solutions, Abertis distinguishes itself by maintaining and strengthening its industry leadership, standing out for its unique approach to road safety and technological innovation, and reinforcing its commitment to an accident-free future in its infrastructure.

2.3. Use Cases

Use Case 01: Solutions to predict and/or prevent accidents on our high-capacity roads.

Solutions that integrate the use of Data and AI for accident analysis, prediction, and prevention across the specified areas or other relevant ones, enabling the development of preventive interventions that ensure the safety of team members:

  • Detect patterns that anticipate accidents and apply preventive measures to minimize risks, using historical and real-time data analysis.

  • Implement early warning systems that inform control centers when risk situations are detected, facilitating a rapid and effective intervention.

  • Preemptively position highway maintenance teams using algorithms that identify where an incident is most likely to occur based on data.

  • Improve predictive models using high-quality data and advanced AI algorithms, allowing anticipation of problems in the infrastructure before accidents occur.

  • Optimize the planning of preventive interventionsensuring that timely measures are taken before risks evolve into serious accidents.

  • Integrate continuous monitoring solutions to identify possible hazards in real-time, such as adverse weather conditions, accidents, or traffic congestion, allowing for a quick and precise response.

  • Develop predictive risk analysis tools that use large volumes of data to predict potential failures in infrastructure or accidents based on traffic behavior.

  • Develop autonomous active infrastructure systems that can communicate danger situations to users and/or vehicles.

Use Case 02: Solutions for managing accidents that occur on our high-capacity roads.

Solutions that integrate the use of Data and AI to improve accident management, enabling a faster and more effective response. These solutions should facilitate safer operations, covering both the specified areas and other relevant ones:

  • Reduce incident detection time by incorporating advanced technology in equipment that activates automatic alerts as soon as the accident occurs.

  • Minimize the response time of emergency teams through optimized coordination and improved communication between control centers and field teams.

  • Optimize the routes and positions of emergency teams to reduce arrival time and increase efficiency in victim protection and care.

  • Minimize the impact on other road users through quick and effective solutions that allow them to continue their route with minimal impact.

2.4 Technological Requirements

Startups must demonstrate both the ability to acquire and process data, which is key to ensuring an effective solution. Startups can present their solutions in a consortium to demonstrate a differential and innovative contribution in both areas.

Startups must indicate what type of data they need to develop their solution and how they plan to obtain it. If the proposal includes the use of AI/ML algorithms, these must meet the following criteria:

  • Security: Privacy, transparency, and robustness in data management.

  • Sustainability: Efficiency in resource use, scalability of the solution, and ease of maintenance.

  • Governance: Compliance with regulations, explainability of algorithms, accountability in their use, and the ability to audit or supervise.

  • Monitoring: Ensuring the correct performance of the models and that no degradation occurs.

2.5 Data Sources

Abertis aims to make a significant leap in the information it uses in infrastructure management, and to do so, it seeks to incorporate solutions based on new data sources, as well as applications with a disruptive component in data sources currently used by the company.

New data sources, prioritizing the following:

  • Satellite data

  • Vehicle data

In cases where the presented solutions are based on any other type of data source (see the list of examples below), the proposal must incorporate a disruptive use of these data. Otherwise, it will not fall within the scope of interest for Abertis.

  • Navigation or geolocation applications

  • Mobile devices

  • Highway cameras

  • Traffic sensors

  • Weather conditions data

  • Data on interventions on the track

  • Data on mass events near the highway (festivals, concerts, etc.)

  • Traffic forecast data (inti)

3. What type of organization is the call aimed at?

We are actively looking for international startups that are duly incorporated as legal and operating entities, actively engaging in their business activities. These companies must provide a justification in their application explaining why their solution might be best suited to address any of the use cases set out by the Zero Accidents AI Challenge.
Specific requirements have been established regarding the Technology Readiness Level (TRL) that the solutions proposed by applicants must meet in order to qualify for the "Zero Accidents AI Challenge". In particular, the solutions submitted should preferably achieve or exceed a TRL of Level 7; however, potentially disruptive solutions below this level may also be considered for evaluation.

TRL levels preferable by Abertis:

TRL 7 - System prototype demonstration in an operating environment:

  • The solution must have a working prototype.

  • It must have been demonstrated in an operating environment that replicates real-world conditions.

  • The functionality and performance of the solution must be demonstrated.

  • While full integration may not be required, it should represent a significant step towards mature operational technology.



TRL 8 - Real system completed and qualified through testing and demonstrations in an operating environment:

  • The solution must be found in or have reached the stage of a real and complete system.

  • Rigorous testing and demonstrations must have been carried out in a real-world operating environment.

  • The solution must be fully functional and ready for implementation, with the possibility of some final refinements.

TRL 9 - Real system proven through successful operations:

  • If the solution has reached TRL 9, it means that it is actively deployed and in use.

  • If must have a proven track record of successful operations, demonstrating reliability and effectiveness.

  • While ongoing monitoring and maintenance may be necessary, it should be considered a mature and well-established technology.


By submitting the application, applicants fully acknowledge and agree that compliance with TRL's specific requirements is mandatory. Preferably, only solutions from TRL level 7 will be considered for the "Zero Accidents AI Challenge"; however, those solutions with a lower TRL will also be valued as long as they are potentially disruptive. This requirement is established to ensure the readiness, reliability and maturity of the technologies proposed to address the "Zero Accidents AI Challenge".


The pilot test will be carried out at an Abertis Group site, and the country will be determined based on the origin of the solution and the specific needs of a particular Abertis Group company. The pilot test will be managed by Abertis' Innovation department, with the collaborative support of the Abertis Group company that will provide on-site assistance.


It should be noted that any application detected as non-original and/or potentially a reproduction of an idea, proposal or solution already existing in the market, or whose industrial and intellectual property rights belong to third parties, will be automatically rejected. Participants are responsible for any claims that may be brought against the Abertis Foundation, Abertis or any company within the Abertis Group due to non-compliance with the above and undertake to indemnify the Abertis Foundation, Abertis or any company within the Abertis Group and to hold them harmless from any claims that may be brought by third parties. Participants will also bear any costs, expenses and damages that may arise from such a situation.

4. Evaluation of applications and criteria to be used

To select the three (3) finalist solutions, the following areas will be evaluated:

4.1. Alignment of the solution with the challenge launched

  • The solution responds clearly, directly and effectively to the problem posed in the challenge.

  • It must address the challenge efficiently, optimizing the use of resources, improving outcomes, reducing timelines, and achieving broad impact.

  • The proposed solution will stand out significantly compared to other competitors who aspire to solve the same challenge.

  • The solution has the capacity to carry out the Pilot with the Abertis Group. 

4.2. Previous experience:

  • The solution should preferably have previously demonstrated success stories related to the challenge and the use cases raised.

  • Even if the solution hasn't addressed identical challenges in the past, it must have valid tools and capabilities to solve them.

  • The time required in the implementation of the solution in similar challenges in the past will be taken into consideration. 

4.3. Team of the startup or candidate entity

  • The complementarity of the team, the capacities and areas of experience of its members and the adequate and sufficient size to successfully address the challenge will be evaluated.

  • The total dedication of the team leader to the activity will be considered.

  • Knowledge related to the scope of the challenge and its use cases will be analyzed. 

4.4. Economic model

  • The proposed solution must be economically sustainable and viable.

  • We will consider whether the business model has been validated in the market.

  • We will evaluate the forecast of an acceptable, desirable, and assumable integration by the organization.

  • A win-win model between the startup or SME's activity and the organization will be sought.

  • The startup or SME must have financial solvency to effectively implement its solution.

4.4. Technology and certifications

  • The technology on which the proposed solution is based should preferably reach TRL level 7 or higher.

  • It will be verified whether the startup has certifications that support the security of its technology, patents, and other quality certifications. In case the solution includes the use of AI/ML algorithms, they must meet the following criteria:

    • Security: Privacy, transparency and robustness in data management.

    • Sustainability: Efficiency in the use of resources, scalability of the solution and ease of maintenance.

    • Governance: Compliance with regulations, explainability of algorithms, accountability in their use, and ability to audit or monitor.

    • Monitoring: Ensuring the correct performance of the models and that there is no degradation.

  • The fact that the solutions are based on the following data sources prioritized by Abertis will be considered an advantage:  

    • Satellite Data  

    • Vehicle Data  

  • In the event that the solutions presented are based on any other type of data source (see list of examples below), the proposal must incorporate a disruptive use of this data. Otherwise, it will not be within the scope of interest for Abertis. 

    • Data from browsing or geolocation applications  

    • Mobile devices  

    • Highway cameras

    • Traffic sensors 

    • Weather Condition Data  

    • Facts about interventions on the track 

    • Data on large events near the highway (festivals, concerts, etc.) 

    • Traffic forecast data (inti)

4.5. Competence

The originality and uniqueness of the proposal or, if there are competitors, the strengths of this solution compared to other solutions already developed will be evaluated.

4.6. Sustainability

The positive impact of the proposed solution on Abertis' sustainability values will be evaluated, including aspects of social, environmental and climate sustainability, among others.

4.7. Solution Application

The evaluation will also consider the level of detail, clarity and completeness of the information provided, as well as the effectiveness, concreteness, adequacy and contextualization of the proposed solution. 

5. Application process

To participate in the "Zero Accidents AI Challenge", interested startups must submit their application through the registration link available at: http://www.f6s.com/zero-accidents-ai-challenge. This link will redirect applicants to a specific section within the F6S platform. Participants must have a public profile on the F6S platform and link it directly to the "Zero Accidents AI Challenge" initiative, either by creating a new profile or using an existing one.

Tthe startup must complete each and every field on the form in full, providing as much information as possible. The application may be disqualified if any fields are incomplete or insufficiently completed.

Likewise, all participants must accept the terms and conditions, as well as the privacy policy provided by F6S Network Limited, accessible through the following link: http://www.f6s.com/terms within the F6S platform. In addition, the Abertis Foundation will make available its privacy policy, as well as the other relevant provisions, which can be consulted at: http://www.beyondroads.abertis.com/politica-privacidad, for the management of participation in the framework of the "Zero Accidents AI Challenge".

6. Calendar

*Note. The dates and phases established in these Terms and Conditions of the Challenge may be modified and/or adapted by the Abertis Foundation at any time and at its sole discretion. Any modifications will be duly posted on the specific website located in http://www.beyondroads.abertis.com.

The "Zero Accidents AI Challenge" will progress through subsequent milestones, scheduled for the following dates:

6.1. Application period: From November 5, 2024 to January 24, 2025.

6.1.1. Launch Event: November 5, 2024

6.1.2. Deadline for receipt of applications: January 24, 2025 at 23:59 (UTC+1), Spanish time*.

*Applications received after the deadline of 11:59 p.m. on January 24, 2025 will not be considered or evaluated by the organizers.

6.2. Announcement of the Solutions Challenge finalists: March 7, 2025.

The three (3) finalist startups will be announced around those dates. The organization reserves the right to declare one or more of these finalist places vacant in the challenge if it considers that the quality of the proposals received does not justify the nomination of the three (3) candidates. The selected startups will be contacted via the email address provided during their registration on the F6S platform. In this contact, each of the selected will be provided with the dates, time and details related to the Connect & Build Sessions.

6.3. Connect & Build Sessions: March 17 – April 4, 2025

The finalist solutions will be invited to participate in a programme consisting of three (3) working sessions with the organising team and Abertis experts. These sessions aim to level knowledge, deepen pilot planning and provide support, guidance and practical knowledge to startups, in collaboration with Abertis mentors. 

The scheduling of the sessions will take place over three weeks, specifically from the week of March 17 to the week of April 4, 2025. The Connect & Build sessions are meetings between the finalist startups and Abertis. The structure of the work sessions is detailed below:

Session 1: Kick Off 
This opening session will serve as a key meeting point between Abertis and the three (3) finalist solutions. The Abertis team will present the objectives of the Challenge, detailing the challenge and use cases, as well as their expectations in terms of innovation and collaboration. The startups will have the opportunity to briefly introduce themselves, and the next steps, the documentation to be prepared and clarifications on the process will be explained.

  • Date: March 17, 2025

  • Modality: Remote session with the participation of the three (3) finalist solutions and the key agents of Abertis.

  • Duration: Between 1 hour and 1 hour and a half

  • Materials: At the end of the session, a Playbook with all the relevant content will be delivered for the startups to work on and present during the work sessions of the Connect & Build Sessions.

Session 2: 1to1 
Each finalist startup will have a one-on-one session with the Abertis team to elaborate further on their proposal. Finalists will be required to submit materials that include:

  1. Solution Fit & Action Plan. 

  2. a. Detailed explanation of the solution: focused on the value proposition of the solution and how it addresses the challenge posed.
    b. Action Plan: (if necessary) to guide the necessary modifications and effectively align the value proposition with the challenge. This will allow the Abertis team to better understand how the solution is adapted to the challenge posed.

  3. Pilot Test Plan: Proposal on the execution of a pilot, establishing clear hypotheses to guide the implementation in a real environment, its approximate schedule, and other key elements for the development of the pilot, such as milestones and indicators.

  4. Regulatory and Safety Framework: Brief analysis of the legal and safety requirements of the real context in which the finalist proposes to conduct the pilot.

  • Dates: Agreed with each finalist on March 24, 25 and 26, 2025.

  • Modality: Individual remote session between the finalist startup and Abertis' key agents.

  • Duration: Between 1 hour and a half and 2 hours.


Asynchronous Touchpoints

  • Theoretical Material: Material on good practices for pitch preparation will be shared via email.

  • Preliminary Pitch Touchpoint: Finalists will be required to submit their pitch materials for preliminary review by the project management team, which will allow for email feedback.

    • Submission Deadline: March 28, 2025

    • Modality: Email

Session 3: Pitch Day Rehearsal 
The finalists will participate in a 1-to-1 rehearsal of their presentation with the initiative's management team.

  • Date: April 4, 2025

  • Modality: Remote session with each finalist.

  • Duration: 45 minutes

6.4. Private Pitch session of the finalist startups: April 10, 2025.

The winning solution will be announced from May 9, 2025. The announcement will be made via email to the address provided by the startups and will subsequently be published through the Abertis Foundation’s and Abertis’ communication channels, in order to share this news widely and transparently.

6.5. Winning solution announcement: Effective May 9, 2025.

The announcement of the winning solution will take place from May 9, 2025. The announcement will be made via email to the address provided by the startups and will subsequently be disseminated through the communication channels of the Abertis Foundation and Abertis, with the purpose of sharing this news widely and transparently.

7. Recognition and rewards

Fundación Abertis is committed to awarding financial prizes to the three (3) finalist solutions of the Connect & Build Sessions, and the winning solution will receive an additional financial reward. The specific amounts are as follows: 

7.1. Reward for finalist solutions

The three (3) finalist solutions will receive a prize of six thousand euros (€6,000) each, sponsored by the Abertis Foundation, for their participation in the "Zero Accidents AI Challenge".

7.2. Reward for the winning solution

Abertis is committed to providing funding to the winning participant up to a maximum amount of forty thousand euros (€40,000) to carry out a pilot project. In addition to the cash prize, the winning participant will establish a business relationship with Abertis.

(*) Abertis reserves the right to determine at its sole discretion the amount of funding for the pilot project, depending on the specific needs of such project.

The release of this amount is conditional on the winning participant effectively fulfilling their commitment to the challenge and the execution of the pilot. Failure to submit regular reports on the progress of the pilot, its results, data obtained during its implementation, or failure to attend follow-up meetings may result in the termination of the relationship and, consequently, the withholding of committed funds. In addition, the Abertis Foundation reserves the right to demand the return of these funds in the event of bad faith or fraudulent behaviour on the part of the winning participant, such as falsifying data, concealing relevant information or failing to comply with obligations in the execution of the pilot.

The winning participant undertakes to formalise their relationship with Abertis by means of a specific contract, the execution of which will be necessary to carry out the pilot. This contract will regulate the aspects mentioned in these terms, as well as other related aspects (without excluding others), such as the appropriate dedication to the purpose of the pilot, the possible extension if investment is received, among others.

If the start of the pilot is delayed for any reason, the payment deadline for each milestone mentioned above will be postponed for the same amount of time as the delay in the pilot. The winning participant must maintain the strictest confidentiality during the development of the pilot and may not disclose or share any information related to it without the express written consent of the Abertis Foundation or Abertis.


7.3. Regarding the reward payment:

7.3.1 Legal steps and required documentation

To proceed with the reward payments, both the finalists and the winner must submit the following documentation within the timeframe specified in the official notification:

  • Legal Identification: Copy of the legal representative’s and the company/startup’s ID document (National ID/RFC/NIF or equivalent).
  • Certificate of Legal Existence: Document verifying the legal existence of the company/startup (articles of incorporation, company registration).
  • Tax Certificate: Proof of tax status or equivalent, depending on the country of origin of the company/startup.
  • Banking Information: Official document with bank details for payment (IBAN, SWIFT, etc.), duly verified and signed by the legal representative.
  • Compliance Declaration: Letter signed by the legal representative of the company/startup confirming compliance with all conditions and requirements stipulated in the challenge’s legal terms.

7.3.2 Payment steps, documentation and timelines

7.3.2.1 Validation process:

Once the required documentation is received, Fundación Abertis will verify that all information is complete and correct. If additional documentation or corrections are needed, participants will be notified to resolve any errors or inconsistencies.

7.3.2.2 Payment timeline:

The reward payment will be made within a minimum of 60 business days following the validation of the required documentation. The payment will be made via bank transfer to the account specified by the participant. In case of delays due to external factors (such as tax validations or banking issues), the organization will promptly notify the participants.

7.3.3 Terms and Conditions regarding payment

7.3.3.1 Taxes and withholdings:

All payments are subject to applicable tax laws. Participating companies/startups are responsible for fulfilling their tax obligations in their country of origin. Fundación Abertis may apply any withholdings required by applicable tax regulations. These withholdings may include, but are not limited to, income taxes, VAT, or other similar charges.
7.3.3.2 Currency:
The reward payment will be made in euros.
7.3.3.3 Disclaimer:
Participants acknowledge and agree that Fundación Abertis will not be responsible for any delays or complications in payment arising from participants’ failure to provide documentation, banking errors, or any other external circumstances beyond its control.

8. Pre-emptive right of Abertis Foundation and Abertis

For a period of one (1) year from the end of the pilot, both Abertis and Abertis Foundation will have the right to advertise and publicize the pilot among its customers and relevant stakeholders, and will have a pre-emptive right to purchase the rights to the pilot in the event the winning participant decides to sell or assign its rights to a third party.

9. Obligations of the participants

Each participant represents and warrants (where applicable) that it:

a) They comply with all applicable laws in compliance with these Challenge Terms and Conditions;

b) They have full capacity, authority and legal right to agree to these Challenge Terms and Conditions;

c) They have provided complete, truthful and accurate information and/or data during the registration process, profiling and/or subsequent communication with the Abertis Foundation, where applicable;

d) They will not attempt to undermine the legitimate operation of the Challenge by providing false information;

e) They will refrain from threatening, harassing or displaying any threatening and/or harassing behaviour towards other participants, Fundación Abertis and/or Abertis (including their employees, directors, officers and representatives);

f) They will provide, from time to time, additional information as required by Fundación Abertis within the specified timeframe;

g) They will comply with the health, safety and security procedures communicated by Fundación Abertis and/or its employees, directors, officers, agents or representatives while inside the premises of Fundación Abertis or any venue of events sponsored by Fundación Abertis;

h) They will refrain from copying, modifying, reproducing, licensing, sublicensing, distributing, transmitting, republishing, or displaying the Fundación Abertis or Abertis information and/or any other material/content provided by Fundación Abertis or Abertis in connection with this Challenge (except to the extent that copying, modifying, reproducing or displaying is necessary and directly related to your participation in the Challenge);

i) They shall not mention the name, trademarks, trademarks, logos, symbols, denominations, emblems, or designs of Abertis or of the Abertis Foundation or the Abertis Foundation, unless expressly authorised in writing by Abertis and/or the Abertis Foundation.

10. Intellectual Property Rights

10.1.Nothing in these Challenge Terms and Conditions shall be construed as granting participants any right to use the intellectual property owned by the Abertis Foundation, Abertis or a company within the Abertis Group, except as provided in these Challenge Terms and Conditions.

10.2.The Abertis Foundation, Abertis and the companies within the Abertis Group (as applicable) retain all intellectual property rights, industrial property rights and other rights in the software, software development tools, know-how, methodologies, processes, technologies, intangible assets, creations, trademarks, patents, etc., that they own or are licensed.

10.3.Participant represents and warrants that 

  1. They solution is an original work and does not infringe any industrial or intellectual property rights. This means that all industrial and intellectual property rights, as well as all the information provided by the participant (images, trademarks, graphic designs, databases, and any other content) are the exclusive property of the Participant or, where appropriate, duly licensed to the participant by the owner.

  2. They own or are a licensed user of all algorithms, codes, and/or data used in the Solution.

11. Indemnification and Limitation of Liability

11.1.Entrants shall fully indemnify and hold harmless the Abertis Foundation and Abertis from any claims, actions, losses, damages, liabilities, costs and expenses, including attorneys' fees and other legal expenses, arising directly or indirectly out of or in connection with (a) any breach by entrant of these Challenge Terms and Conditions; (b) any failure by the participant to comply with its obligations under these Challenge Terms and Conditions in compliance with all applicable laws; (c) any violation of the rights of third parties; and (d) fraud, negligence, or wilful misconduct by entrant.

11.2.To the extent permitted by law, in no event shall the Abertis Foundation or Abertis be liable for any lost revenues, lost profits, incidental, indirect, consequential, special or punitive damages, nor shall they be liable (whether in contract, tort or otherwise) for any losses arising from the participant's participation in the "Zero Accidents AI Challenge".

12. Termination

Fundación Abertis reserves the right to suspend or terminate the Challenge at its sole discretion and at any time. The exercise by Fundación Abertis of its right to suspend or terminate the Challenge shall not entitle the participant to any fee, damage, claim for expenses or loss of profit, or to any other legal or patrimonial remedy with respect to such suspension or termination.

13. Force Majeure

Fundación Abertis shall not be liable to the participants nor shall it be deemed to have breached these Challenge Terms for any delay in performance or failure to comply with any of its obligations, if such delay or failure is due to any event or circumstance beyond the reasonable control of Fundación Abertis.

14. Confidential Information

14.1. "Confidential Information" means any information provided to the participant by the Abertis Foundation, its advisors or any company in the Abertis Group, whether orally or in writing (in electronic format or otherwise), which is marked as confidential, or which can reasonably be understood as confidential. The term Confidential Information shall include all information, including, but not limited to, all trade and industrial secrets, data, digital content, know-how, computer programs and software, patents, designs, specifications, technical processes and formulas, applications, tools, DRM requirements, or any other technical, manufacturing, business, financial, operational, administrative, commercial, or economic information, whether or not disclosed in a timely manner. oral, written, electronic, visual or other form and all documents, notes, analyses, studies, reports or other information, based on or derived from the Confidential Information.

14.2. Participants make a commitment to:

  1. Not disclose the Confidential Information to any third party without the express written consent of Fundación Abertis.

  2. Not use the Confidential Information except in connection with the Challenge and in accordance with these Challenge Terms and Conditions.

  3. Use the same degree of care for Confidential Information that you would use for your own confidential information of similar importance but no less than reasonable care, including, without limitation, ensuring the proper and secure storage of all written, tangible, and/or intangible Confidential Information in your possession.

  4. Comply with all applicable data protection laws with respect to the processing of any personal data contained in such Information, including, but not limited to, implementing such minimum-security measures as may be required by law to protect such data against unauthorized access, alteration, loss, or destruction. 

15. Personal Data

The processing of personal data by the Abertis Foundation associated with the celebration and development of this "Zero Accidents AI Challenge" will be carried out in accordance with the provisions established in the Privacy Policy of the "Zero Accidents AI Challenge"

16. General

16.1.It is not an offer or a contract 

(a) Participants recognize that:

  1. their participation is voluntary;

  2. that no confidential, fiduciary, agency or other relationship, or implied contract of fact exists between it and Fundación Abertis or its affiliates, and that no such relationship is established by your application for the challenge; and

  3. understands and accepts that nothing in these Challenge Terms and Conditions may be construed as an offer or contract of employment with Fundación Abertis or its affiliates.


16.2. Amendments 

Fundación Abertis reserves the right to modify these Terms and Conditions, at any time, at its sole discretion, as well as the configuration and, in general, any other content related to the challenge.

16.3.No waiver

The failure of Fundación Abertis to exercise or enforce any of the rights conferred on it by these Challenge Conditions shall not be considered a waiver of any of these rights nor shall it prevent the exercise or execution of such rights at any time or times thereafter. Any express declaration of a right of Fundación Abertis herein is without prejudice to any other rights of Fundación Abertis that are expressly stated herein or arising from law.

16.4.Divisibility 

If at any time any provision of these Challenge Terms and Conditions were or becomes illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of these Challenge Terms and Conditions shall not be affected or impaired hereby, and shall continue in force as if such unlawful provision,  invalid or unenforceable has been severed from these Challenge Terms and Conditions.

16.5.Applicable legislation

These Challenge Terms and Conditions shall be governed by and construed in accordance with the laws of Spain, and each entrant submits to the jurisdiction of the courts of Madrid.
